MY PD is Nov-07. I was just wondering as my GC is for future employment. Can I go back to home country and come back when I get EAD.
What are the limitations in this path. Do we always have to be in USA on valid H1B.

Today after more than a year of calling I was forwarded from NSC to Los Angles office. Looks like NSC CS is offline.
I used to call and narrate my case issues and they would say they emailed or asked me to callback. And my calls went nowhere. Today it got routed to LA office and they listened to my issue and said they are escalating the call and then I got to an officer. He took my case issue and gave me a service request no. NO ONE in Nebraska told me there was something called service request. (though I read about it recently in this forum). I had asked numerous times to the NSC CS how can I track my calls and they said you couldnt.
I think NSC CS should be sued for giving wrong info

May be we can add a primer on how to evaluate a bill when it comes out of the senate or house in next few months...

All,
My lawyer received an RFE on my EB3/RIR labor cert on priority date 01/26/04In Feb sometime and responded back exactly on the last day (03/01/07) it was due. I have not heard anything back from DBEC since then. Anyone here have any idea how much time they take to approve the labor after RFE is responded back, if at all they do approve it? I know couple of my friends in CA who got their labor approved within a month after their RFE was responded back. My labor was filed from WI.
Please post your experiences if anyone experienced this before. The RFE was about company's financial document. I am not worried about the financial status of the company as it is doing pretty good from last 3-4 years consistently.

We have just received another H-1 approval for an end-client placement. There were two intervening vendors and the end-client declined to provide a letter stating that there is no requirement in law for them to provide any such letter. We had to get together convincing secondary evidence. I was highly doubtful we will get the approval, but we did. So, despite the January 8 memo from USCIS, there is life yet for consulting industry.

I am currently working on H1B. My wife is currently in India with approved I797 for H1B (starting Oct 07). We are debating whether to get H1 or H4 stamped on passport. (H4 is totally our decision and for H1 we need to depend on her company's schedule).
- Can she come to the US on H4 (lets say next month) and if and when she finds a job (lets say next year), can she switch to H1? Is there a time limit before H1 will become invalid?
- If she comes to the US on H4, are there any issues changing status to H1?
- Are there issues when she goes to India again to get H1 stamped?
- Is there a difference between the I797 approval notice if a person is out of US vs. in US? (I have read something about I-94. I thought I-94 is always attached to 797 approval notice).

I had a H1-b visa until September 2008 from Company A. I transferred the H1-B to Company B and it was approved in December 2008. When I went for my stamping in March 2009 it was denied under 221(g). My employer then withdrew the H1-B petition because of lack of projects. I am now planning to apply for a B1/B2 visa at the Mumbai Consulate. Any one have a similar experience to share or have an idea on my chances of sucess?

Hi,
I have a question regarding the I765 form. In the I 765 form it says Have you ever before applied for EAD to USCIS. I did my MS from US University and got OPT also known as EAD and worked on it for an year. Now my question is do i check yes or no? Do i consider that as EAD or just OPT.
