I have always been a passive reader of this post and multiple other similar posts. It helped me a lot and I thought sharing my positive porting experience will help/encourage others. Below are details of my long journey

You are turning the basic premise upside down. H1B transfer becomes a reality.
Rather, you should ask, employee-petitioned H1 transfer in adition to Employer-petitioned H1 transfer. What say you?

Fortunately the US justice system works for everybody. Thats the hallmark of this great country.
Anybody can go to a court and seek justice if they feel they have been harmed or suffered losses even by a govt body.
Ample evidence is available in court records for cases against USCIS by GC applicants for delays and errors. This not an opinion but a fact.
In this country you just don't get screwed or get a cold shoulder for seeking justice within the written laws.
Unfortunately numbskulls like villamonte and DED don't have a mental capacity to understand these concepts

That memo/document you pointed out is an interpretation. We have already said that USCIS's interpretation is incorrect. We intend to correct this interpretation with this lawsuit.
Infact, it would be wrong to call this a lawsuit.
We are aiming for an injunction (or a stay order) in step 1 of the lawsuit that would prevent USCIS from working on any interfiling/PD porting requests.
If the injunction is with retroactive effect, all the EBs (not just EB3) who have ported their PDs will have their cases frozen. USCIS would not be able to work on them.
The remainder of the lawsuit can take its sweet time... the injunction should serve the primary cause.

First of all, forget about back firing, can we get 100 people to do this. IV has been trying for funds and i dont think even 10% have contributed..why would u think any one would loose a pay day? even if you take 20$/hour i.e 160$ per day. Lot of members are not ready to contribute 50 bucks :) There might be a few who can not contribute due to various reasons and i totally sympathize with them but what about the remaining?
My point is not to discourage but just for a reality check

More than 4 years ago when I started the process I really was looking forward to getting a GC and eventually citizenship. But a lot has changed in the last 4 years. GC process has become much harder (after 4 years I am yet to file for 140 and 485). At the same time the economy back home is booming. So the financial incentive to go thru the long process is really going down by the day.
More than the financial factor, I have gradually started realizing that no matter how many friends I make here its never the same as having a large family network that provides for social stability for each family. Also, I have started observing aging indian couples in US who came in 60's and 70's. They look pretty lonely and sad. I guess the question I am asking myself today is, is finanical success today worth the social loss I will face once I retire?
PS: Does anyone know how to turn a thread into a poll?

My brother sisters are getting older, and I feel I am drifting away from them because I hardly get much time to spend with them even when I go to India. So GC or no GC, I am going back.
Now I am here for 2 reasons, my wife is studying, I am stuck with a house. My wife's studies are almost over. So as soon as I can break even on my house, I will go back. Period.
My wife couldn't get an internship this year due to not having GC. She has converted to F1 after waiting for a long time, and hopefully this year will get an H1. So GC has no real value for me now. Only value GC has for me is that I can live more independently switch employers, experiment with startup ideas etc. while I am here.

Received a direct deposit from IRS today of $1200. I am on H1B and my wife on H4 and both of us have SSNs. We had filed jointly.
Also another friend of mine received his refud for a family of 4 - he is on H1B, wife on H4, both have SSNs, one daughter US citizen (has SSN) and another daughter Indian citizen (no SSN). He got 600 + 600 + 300= $ 1500.
It all adds up...

You must be CEO, CFO or something like that... very impressive..
It is not a big deal dude...if not for this immigration system, we could be making even more..think about $80-$100/hr if you are an independent contractor. This a minimum for a decent contract with vendor directly.
And if you have ~100-200K for investments, with some experience and any luck..you could be making another 100K out of it from trading and active investing in other areas. That comes to ~250-300K minimum. There are no bounds when life is free and in this great country. Unfortunately, things have turned discriminative and our potentials are being restricted(atleast for non-EAD guys) and you have to be prepared for getting outright kicked out of this country.

I think the at the heart of this kind of reckless, selfish 'crusade' is a problem with poor upbringing. Some kids are brought up to look at the world through myopic self-interests, and are molly coddled by their parents into believing that their narrow views are indeed honorable and respectable.
The sad reality is that such 'crusades' do nothing more than unite those against the larger cause of brown/black/non-white immigration and divide those that are already in pain.
No wonder then that history repeats itself ever so often when those from the 'great Eastern lands' can so easily be ruled by those with shorter histories and accomplishments.
Take a look at illegal immigrants. They break the law. Yet, they are able to unite so effectively to make themselves heard. For a group that has absolutely no locus standi for legal or political relief, they are amazingly effective in shaping the dialog around their interests.
As a strategy and communications professional (with a strong background in Harvard Law School mediation/negotiation and US public policy) I can vouch for the effectiveness of a united voice that speaks to larger interests oriented towards US economic gains. These kinds of narrow sub-optimal "causes" only make the USCIS and the larger establishment care less about legal employment based immigration.
Absent in this dialog from this 'erudite PhD' is analyses of root causes of underlying problems. For one, there is the absolutely crystal clear problem with country based quotas for employment based immigration in a country where the primary act, i.e., employment itself cannot be discriminated based on national origin. And so on and so forth.
Instead of taking cause with such short sighted and self-centered acts, why not apply your collective 'high skills' towards highlighting the POSITIVE CONTRIBUTIONS of legal immigrants and pushing for a better overall process?
Instead of collecting money to slit the wrists of those around you, why not join hands and petition the lawmakers for better, more transparent processing estimates?
Instead of trying to make a futile argument that EB1 > EB2 > EB3, why not attempt to have a real public policy dialog that reframes larger interests?
Further more, dont forget that when the USCIS needs to respond to such frivolous lawsuits, it costs US taxpayer dollars... which further alienates the USCIS and Citizens from the cause of legal immigration.
No wonder then we find an increase in backlash against non-white immigrants that seek a higher sense of entitlement... seriously... I can bet just as I did with that SunnySurya joker a while ago, put your EB2 petition up online and let us see if there really is no US Citizen available to do the job.
What makes it fair for a foreigner like you to come to this country and claim that there there is NO ONE to do the job based on which you seek to immigrate?
If you are really serious about US national interest and the larger question of fairness, it is only fair that you post the EB2 job and we confirm that there is no US person ready and able to take that job. And dont try those advertising tricks, I will hire a lawyer to smoke out your games.
BTW, I will be looking out for this lawsuit. I will get the details from you directly without you even knowing about it. Heck, I will even contribute to your "cause" so that you give me the details. Then, I will file a separate petition to have your specific EB case investigated for the merits your lawyer posed. Ready for that game?

I am for it ( without diluting our present progress).
In fact it is the real date which makes sense & also provides relief to all H1-B new or old. New guys can peacefully change their jobs till their PD becomes current & do not get screwed by employers
