Hi All,
USCIS has mailed my wife two different EADs upon renewal. The first EAD sent to us has a 2yr validity. About a couple of weeks later, she got another one, this time with a 1yr validity.
I spoke with my attorneys and they seem to indicate that the one with the 2yr validity should be the valid document of reference from here on.
My questions are,
1) have any of you experienced this kind of a goof up before?
2) do I just take my lawyer's word for it and ignore one of them?
Please advise...

This is my situation:
I am in my 8th year of H1B extension (2 one year extensions after 6 years)
I had my LC I140 approved, but due to retrogression I cannot continue with the adjustment of status.
This is my question:
If I move to a new position that would require me to file new LC (PERM), am I still subjected to the 365 days rule?
I am confused because my employer filed the LC 365 days prior to my H1B expire on the 6th year in order to get the extension. Now, since I can only have one year extension and I have less than 1 year left on my H1B visa, can the new LC still be filed? Will this jeopardize future H1B extension?
Am I missing something here? Is there another strategy?
Based on other discussion, it seemed that I am eligible for 3 years extension. But there are still 200 days left on my H1B visa. I suppose 3 years extension cannot be filed until near expiration date.

Hi,
I am Vijay Vellabati, finished MS in Dec-06 and I got a job in Jul.
I am in my OPT(Optional Practical training). I did not get to file for my H1-B.
Can my company apply for Green card for me right now.
Because I need to keep my status, my OPT expires in Dec-07.
If anyone can get back to me, I would appreciate that.

Yes, green card is for future employment, your employer can apply for your greencard!!
But usually the greencard process takes so long that it is nearly impossible to get it in a year (the time you have in OPT) so the safe bet is to apply h1b otherwise in US-Masters quota if you have one. And take it from there.

I am on H4 visa now and when I was on F2 visa I have used medicaid and wic for prenatal care. It was used during my pregnancy only. I am never asked for that in my h4 visa inteviews. Since my husband is applying for CP for green card . Will it be a problem for me to go for CP ? Will consular office consider it a public charge and deny my GC ? Just in case if I get denial how to overcome that denial ? is there a standard process ? Will it affect my husband's GC ?

For the second time this month, a local South Carolina Republican Party committee is expected to decide soon whether to formally scold Sen. Lindsey Graham (R-S.C.) for supporting the Senate's now-stalled immigration overhaul proposal, putting the once-popular lawmaker on the defensive and upping the ante for a potential 2008 primary challenger.
"The frustration [with Graham] is real," said one state Republican source, who added that the state's large conservative base is "just searching for someone" to challenge Graham in next year's primary.
The Spartanburg County Republican Party is expected to vote Aug. 23 on a resolution officially rebuking Graham for supporting his chamber's immigration bill. Criticism of the reform package, which was shelved last month after failing to gather the 60 votes necessary to cut off debate in the Senate, has raged throughout the country and particularly in states such as South Carolina, where AM talk-radio hosts have bloodied the Senate proposal and said it tries to reward those who have broken the law.
Rick Beltram, chairman of the Spartanburg County Republican Party, said he doubts a resolution criticizing Graham's stance on immigration would pass by a wide margin. But should the measure come up for a vote, Beltram already has developed a game plan to manage what likely will be an angry lot.
"This being as explosive as it is, we would ask for a secret ballot so 30 or 40 Rep. Ron Paul [R-Texas] people yelling in the background wouldn't have an influence on the election," Beltram said.
Last week, the Greenville County Republican Party passed a resolution censuring Graham for continuing to "adamantly support legalization of illegal immigrants." In addition to immigration, local party officials reprimanded Graham for supporting campaign finance reform and participating two years ago in the "Gang of 14," a bipartisan Senate group that negotiated a compromise on controversial federal judicial nominations.
The resolution also criticized Graham's recent statements before the National Council of La Raza, which were captured by cable news networks.
"We are not going to run people down. We are not going to scapegoat people. We are going to tell the bigots to shut up and we're going to get this right," Graham told the crowd.
Samuel Harms, the Greenville GOP chairman whose group adopted a resolution in 2001 "opposing any legalization of illegal immigration," said Graham's speech to La Raza was the "straw that broke the camel's back." He added that the resolution was "about informing people that Lindsey Graham called the good people of Greenville bigots and that we need to be told to shut up."
A successful censure vote next week in Spartanburg may signal a widening opportunity for a potential Graham challenger next year. So far, Graham faces only token primary opposition and last month he dodged a potential bullet when popular state Treasurer Thomas Ravenel (R), who was considering a run, was arrested for allegedly distributing cocaine.
Democrats have yet to find a challenger to the first-term Senator.
After recapturing some of the love lost during his Gang of 14 days, a GOP source said Graham's recent bruising for supporting the immigration bill may convince some conservative party activists that an opportunity is again at hand. Also, Graham's support of tanking presidential candidate Sen. John McCain's (R-Ariz.) campaign, the source said, is not helping his cause.
"The immigration issue reignited the ember," the source said.
Still, with Graham sitting on $4 million in the bank, potential primary challengers face a steep uphill battle contending with an incumbent who may have twice that total squirrelled away before the year's end. Lt. Gov. Andr� Bauer (R), frequently said to be mulling a run, told Roll Call last week that he has not ruled out the possibility of challenging Graham.
"I would never say never," Bauer said. "But I don't have any plans to run against him."
But Bauer does plan to appear at the Aug. 23 meeting of the Spartanburg County GOP.
Katon Dawson, chairman of the South Carolina Republican Party, said that while it's unusual for party activists to go to such extremes with federal officeholders, the immigration issue has struck a nerve with the party's base.
"You can't bluff it, you can't beat around the bush about it, it's there and it's real," he said. "Lindsey has a different philosophy on immigration and there's no question it's hurting him."
For now, Graham appears to be resting on his conservative laurels and betting that the controversy will pass. Graham currently is out of the country, his campaign said Friday, but will return to the state to campaign later this month.
"Lindsey Graham is a strong conservative voice in the U.S. Senate with a lifetime conservative rating of 91," according to a statement provided by spokesman Scott Farmer. "He will seek re-election based on his conservative voting record and willingness to tackle the hard problems facing our nation."
Whit Ayers, a Republican pollster, said immigration undoubtedly is a challenging issue, but one that plays to Graham's strengths. Even more, despite the current controversy, Ayers said voters ultimately respect lawmakers who take principled positions.
"Sen. Graham is a remarkedly adept politician who will be able to be very persuasive about the reasons why he's done the things he's done," Ayers said. "I don't think we would expect our politicians to be in lock step on every single issue that comes up."
He added: "There's no question that Lindsey Graham is right where most Republican voters in South Carolina are on God, guns, gays and taxes."

Hi,
H1 Company is based in Phoenix with another office in delaware.I have gievn my address from NewHampshire on my LCA and NJ on my I 140 application.I work for a client in Newyork.I have given my address in New hampshire as I was not sure that my project will be for a longterm and gave my cousins address in New Hampshire for LCA.
I got an RFE asking why I have different addresses on my LCA and I140 while my company is based out of Arizona and Delaware.Please suggest how I should be answering this.

My I-485 receipt from USCIS does have my priority date listed. In fact, they even say on the receipt that the priority date listed might not reflect the oldest priority date that you might be eligible for.

Hi,
I have been working with a company ABC from April 2007 in India. In Oct 2007 I got my H1B visa stamped for a company XYZ of USA and is valid thru OCT 2010. I took a long vacation here in India and went to USA for the company XYZ and stayed there for 45 days. During the period of stay I got my SSN and also I got one payslip generated for two weeks. Becoz of the market slowdown I had to return back to India and joined the same company ABC in India. Now this company ABC wants to process B1 for me, So is there any problem if I have to apply for B1 and is there any problem in the Embassy about the 45 days I spent in US on H1B while I was employed in a company ABC from April 2007?
Please suggest me on this asap

My wife recently got her H4 extension approved. She got her I-797 approval form. While going for H4 stamping, Is she required to carry my original H1B I-797 also?

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. How can they do that? Easy! Let's say...

I received a RFE of my I485, and was asked to declare my self-employment since Dec,31, 2006. I have been engaged in Market America Direct Sell business at part-time since August 26, 2005, and have claimed buinsess lost in my wife and my joint tax return since 2005. In 2006, I got a 1099 form that showed $600 income from Market America. After that I didn't have any income from the business.
My last entry into USA is 07/05/2008, but the I-94 was not replaced at Niagara Falls port. The last entry date on my passport is still Dec, 31, 2006. My EAD start date is 7/31/2008.
Does any have similar case? Please advise. Any help is appreciated.

Tried to post in another, old thread - no response for several days, so decided to create a new one.
I asked my employer to create sub-account for me at http://www.plc.doleta.gov so I could check my PERM case status without polling them. The employer got back to me and said "looked into the site and I couldn�t find the way to create user account to view your case only".
They dont mind making sub-account for me, same way they do for attorneys and paralegals, but they dont want me to see their other pending cases or any information, unrelated to my case. So, my question is: is there a way to create sub-account, which would allow seeing my own case only?

I am seeing people with july 2nd dates getting their checks cashed, and there maybe a quick jump after July 2nd because of the bulletin fiasco we had. And plenty of people have filed after July 17, Could someone tell me if their checks have got cashed? This could be a helpful thread for After 17th filers.
