Hi,
I'm on F1 visa and married to a GC holder. Should i apply for a dependent GC (I-130) on my husband's GC OR be on my F1 status untill the time he becomes citizen and then apply for the dependent GC?...What are the exact wait times for I-130 now?
If i dont apply for I-130 and go out of the country, will there be any issues while coming back to this country. What do you thing is the best way to go..
I'm ready to take some legal advice, so please let me know.

Hello,
Just wanted to update everybody on this. We went for renewal this morning. Took EAD, Passports and Original 485 receipts with us. When we showed our EADs the lady asked her sup, that these guys have EADs do they need anything else. Sup said with EADs nothing is needed. No Passports, No 485 receipts not even Employer letter. They renewed licenses till validity of EAD. We had 2 year EAD. So we are all set till mid of next year.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. economy has slowed down immigration. Otherwise, numbers were pretty high.
it was projected that "Whites" would become minority by 2042.

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.
Thanks for your help.
Visa stamp doesnt define your legal status or your stay period ,it is the latest I 94 . Visa stamp is only required when u travel outside the country.

Hello,
My wife had misplaced her AP summer of last year when she was out of the country. She then entered back on Transportation letter however at poe the immigration officer assumed she was a resident misplaced her resident card and stamped her passport as LPR. Since her entry back in the summer of last year we have gained an extension of H4 status for 3 years. I am getting ready to file for a new AP and would like to know if I should writeH4 as her "Class of Submission" or LPR or AP

We should not look ungrateful. People will appreciate this community even more if we show gratitude too. The press we got for our non violence movement along the lines of Mahatma Gandhi, speaks of our integrity and our culture.
We have a strong cultural background, with Mahatma Gandhi as our visionary and ideal. We follow his principles and I am sure if he had been here today, he would have had the same drive to thank the government for revoking their decision and restoring faith in the immigrant community?

Hi,
I am planning to go to India for 3 months. I have EAD and AP, H1B visa stamping valid till 08/30/2010. Now I am on EAD.
From past 3 months, I don’t have project, so I am thinking to go India and come back in the month of Jan 2010 (if US market improves).
My wife is working on EAD and she will be staying in US.
What are the problems I may face at POE, US? (Possible Chicago POE)
Please let me know, what r all docs required and what r all questions will be asked, if I enter on AP or on valid H1B visa stamp.

The annual Consumer Electronics Show kicks off this week in Las Vegas. This is the gadget wonderland I've attended for the last several years. Due to my father's illness, I decided to skip this year's show. But I'm avidly watching online for announcements of the year's best new innovations. My friends wife applied for h1b and left for India on march 30th, while on H4, they got their h4 stamped april 5th, and still dont know about status of h1b application. The i94 number mentioned in the I129 is the old I94 which was surrendered at port of exit. When they reenter sometime in may, she will get new I94 , which will of course, be valid exactly as the I94 mentioned on I129.
1. Will there be any other problem in port of entry , as she will be entering on H4 stamping.
2. Will the h1b application get rejected or queried.
