    Folks,

    We received letter from USCIS NSC saying that our AP (incl. my spouse) were approved on 10/15/08. On 11/17/08 we received RFE on my spouse AP application for photos. My wife had already left for India (11/15/08) assuming that our AP was approved. Anyways.

    My question - If NSC approves her AP application (again), which date will she have on her approved AP application (i.e will the date be still 10/15/08 OR after the RFE response for photos). Photos were received at the NSC on 11/26/08.

    Is anyone in the same situation. Your input is much appreciated.

    I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

    Mr. Rove is a former adviser to President George W. Bush.

    This week is the one-year anniversary of Democrats winning Congress. But House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid probably aren't in a celebrating mood. The goodwill they enjoyed after their victory is gone. Their bright campaign promises are unfulfilled. Democratic leadership is in disarray. And Congress's approval rating has fallen to its lowest point in history.

    The problems the Democrats are now experiencing begin with the federal budget. Or rather, the lack of one. In 2006, Democrats criticized Congress for dragging its feet on the budget and pledged that they would do better. Instead, they did worse. The new fiscal year started Oct. 1--five weeks ago--but Democrats have yet to send the president a single annual appropriations bill. It's been at least 20 years since Congress has gone this late in passing any appropriation bills, an indication of the mess the Pelosi-Reid Congress is now in.

    Even worse, the Democrats have made clear all their talk about "fiscal discipline" is just that--talk. They're proposing to spend $205 billion more than the president has proposed over the next five years. And the opening wedge of this binge is $22 billion more in spending proposed for the coming year. Only in Washington could someone in public life be so clueless to say, as Sen. Reid and Rep. Pelosi have, that $22 billion is a "relatively small" difference.

    Let's also be clear about what it means to roll back the president's 2001 and 2003 tax cuts, as the Democrats want to do. Every income-tax payer will pay more as all tax rates rise. Families will pay $500 more per child as they lose the child tax credit. Taxes on small businesses would go up by an average of about $4,000. Retirees will pay higher taxes on investment retirement income. And now we have the $1 trillion tax increase proposed as "tax reform" by the Democrats' chief tax writer last month.

    Failing to pass a budget, proposing a huge spike in federal spending and offering the biggest tax increase in history are not the only hallmarks of this Democratic Congress.

    Beholden to MoveOn.org and other left-wing groups, Democratic leaders have ignored the progress made in Iraq by the surge, diminished the efforts of our military, and wasted precious time with failed attempts to force an immediate withdrawal from Iraq. They continue to try to implement this course, which would lead to chaos in the region, the creation of a possible terror state with the third largest oil reserves in the world, and a major propaganda victory for Osama bin Laden as well as for Iran, Hamas and Hezbollah.

    After promising on the campaign trail to "support our troops," Democrats tried to cut off funding for our military while our soldiers and Marines are under fire from the enemy. For 19 Senate Democrats, this was simply a bridge too far, so they voted against their own leadership's proposal. Democrats also tried to stuff an emergency war-spending bill with billions of dollars of pork for individual members. Now the party's leaders are stalling an emergency supplemental bill with funding for body armor, bullets and mine-resistant vehicles.

    After pledging a "Congress that strongly honors our responsibility to protect our people from terrorism," Democrats have refused to make permanent reforms of the Foreign Intelligence Surveillance Act that the Director of National Intelligence said were needed to close "critical gaps in our intelligence capability." Their presidential candidates fell all over each other in a recent debate to pledge an end to the Terrorist Surveillance Program. Then Senate Democratic leaders, thinking there was an opening for political advantage, slow-walked the confirmation of Judge Michael Mukasey to be the next attorney general. It's obvious that this is a man who knows the important role the Justice Department plays in the war on terror. Delaying his confirmation is only making it harder to prosecute the war.

    Democrats promised "civility and bipartisanship." Instead, they stiff-armed their Republican colleagues, refused to include them in budget negotiations between the two houses, and have launched more than 400 investigations and made more than 675 requests for documents, interviews or testimony. They refused a bipartisan compromise on an expansion of the State Children's Health Insurance Program, instead wasting precious time sending the president a bill they knew he would veto. And they did this knowing that they wouldn't be able to override that veto. Why? Because their pollsters told them putting the children's health-care program at risk would score political points. Instead, it left them looking cynical.

    The list of Congress's failures grows each month. No energy bill. No action on health care. No action on the mortgage crisis. No immigration reform. No progress on renewing No Child Left Behind. Precious little action on judges and not enough on reducing trade barriers. Congress has not done its work. And these failures will have consequences.

    Democrats had a moment after the 2006 election, but now that moment has passed. They've squandered it. They have demonstrated both the inability and unwillingness to govern. Instead, after more than a decade in the congressional minority, they reflexively look for short-term partisan advantage and attempt to appease the party's most strident fringe. Now that Democrats have the reins of congressional power, their true colors are coming out and the public doesn't like what it sees.

    The Democratic victory in 2006 was narrow. They won the House by 85,961 votes out of over 80 million cast and the Senate by a mere 3,562 out of over 62 million cast. A party that wins control by that narrow margin can quickly see its fortunes reversed when it fails to act responsibly, fails to fulfill its promises, and fails to lead.

    Friends Hi :
    I have one question. Once we receive EAD and all 9 yards notices and once you switch from H1 to EAD system with same employer, are you still bound to work with same employer for full 40 hours.. can you cut your hours to 20 hours (nooo second job too). I can just work 20 hours a week . Is that permissible to be on EAD and still get GC processed?
    Pls. advise me

    Hi

    I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.

    Is this correct? Or is the lawyer being overly cautious?

    If such a rule does exist can you please point me to the exact regulation?

    My manager got an email from USCIS saying my I140 is approved and they will mail the approval notice. Online case status show that approval notice emailed. But we haven't received any emails about the approval notice. Do USCIS sent paper approval notices??

    Right now they have not even done with July 2nd filers.
    Also ppl whose applications have been transfered have not got any receipts.

    About the 17th July, i think we should be atleast looking for minimum 15-20 business days.

    I will request you to please concentrate on the September Rally. It will bring relief for all of us.

    Hello,

    Will there be any problem if there is any address overlap in the addresses given for the last 5 years and outside US address for more than a year.

    In my 485 application, dates of India address is overlapping with US address for 1 year. Will it be a problem, if it is how to correct it since my application was already sent?

    WASHINGTON (AP) -- In the eyes of the public, Congress is doing even worse than the president.

    Public satisfaction with the job lawmakers are doing has fallen 11 points since May, to 24 percent, according to an Associated Press-Ipsos poll. That's lower than for President Bush, who hasn't fared well lately, either.

    Bush has been taking heat over the Iraq war, his decision to spare a former top vice presidential aide from going to prison and his desire for an overhaul of immigration laws that critics said would give a free pass to illegal immigrants. His job approval rating in the AP-Ipsos survey remained virtually unchanged at 33 percent.

    The 24 percent approval rating for Congress matched its previous low, which came in June 2006, five months before Democrats won control of the House and Senate due to public discontent with the job Republicans were doing.

    Just two months ago, 35 percent of the public approved of Congress' work.

    Poll respondents from both political parties say they're tired of the fighting between Congress and the White House, and want the two branches of government to work together on such issues as education, health care and the Iraq war.

    "They don't approve of anything he does," Theresa Holsten, 55, a Republican and unemployed resident of Lawton, Okla., said of Congress. "He can't do anything right, according to what some people say. It irritates the living daylights out of me."

    Tammy Lambirth, 42, a data researcher from San Antonio, disapproves of "all the fighting that they do all the time."

    The latest tussle involves Bush's refusal to hand over documents and let former White House aides answer questions from the Democratic-controlled Congress about the firing of U.S. attorneys. The dispute could end up in federal court.

    "The Republicans are just stonewalling everything, and the Democrats are just not stepping up and making them do what they need to do, especially about Iraq," said Lambirth, a Democrat. "They need to make our troops get out of Iraq."

    While the public's approval of Congress has dropped 11 points since May, the percentage of Democrats who are turning up their noses at Congress - like Lambirth - nearly doubled. Among Republicans, though, not so much.

    Approval among Democrats fell 21 points, from 48 percent in May to 27 percent.

    It remained low among Republicans, at 20 percent, and has not changed significantly in the past two months.

    Democrats won control of Congress on the strength of their promises to end the Iraq war, but so far have failed to do it. Bush vetoed one spending bill that included a deadline for ending the war, and Democrats don't have the votes to override him.

    An increase in the federal minimum wage became law, but much of the Democratic agenda has cleared the House only to become bottled up in the Senate, where the party has a much narrower working majority.

    Democrats need to be mindful of the public's satisfaction with Congress' productivity, especially as the party campaigns to win back the White House in elections next year, said political science professor Kenneth Sherrill.

    "If you manage to persuade a very large number of voters, including an increasing percentage of people who associate with your own party that you're not capable of governing, you're in real trouble," said Sherrill, who teaches at Hunter College in New York City. "That is not a good message to send."

    Among other survey findings:

    Bush's marks on his handling of the economy and domestic issues like health care, education and the environment, held steady, at 37 percent on the economy and 33 percent on domestic matters. Last month, Bush was at 37 percent approval for his stewardship of the economy, and 32 percent on domestic issues.
    On handling of foreign policy, including terrorism, 38 percent approved, compared with 35 percent last month.
    On handling the Iraq war, 31 percent approved, compared with 28 percent last month.
    One-fourth of the people, or 26 percent, said the country is headed in the right direction. Last month, 21 percent said the country was on the right track.

    The telephone survey of 1,004 adults was conducted July 9-11 in English and Spanish by Ipsos, an international public opinion research company. The margin of sampling error was plus or minus 3 percentage points.

    Hi all,

    I need some good advice and facts...

    My friend's H1-B extension is approved but the stamping (Mumbai consulate) might get denied due to a previous (dismissed) charge for driving with suspended license.

    What are the options after that? Can he re-apply for the visa stamping again using the same H1-B approval petition? Can we appeal the decision since it document clearly states that the fine was paid?

    Please advise.

    mate take it easy. my appli's were sent to NSC on august 1st and i still haven't seen any receipts come through for 485, ead nor AP. Although I have received Ead card and done finger printing so that way I know what my 485 appli # is but no info on the AP

    My I-485 has been pending for more than 6 months now. I have an EAD but I got an RFE on my AP. I don't know what its about as I have not received the RFE yet.

    I am thinking of changing my job. In my new job I don't want to use my EAD since my AP status is still hanging. Can I keep working on H1-B visa as I still have 3.5 years left on my H1? If I travel outside the country, can I re-enter with a valid H-1B visa? Can this cause an abandonment of AOS if I enter on H-1B while my AOS is pending? Please let me know. Thank you.
