Thanks for your reply. I was off for a month and a half to complete a paper for my Masters and have proof for the same...I was not able to juggle both work and studies....will USCIS consider this excuse to be at home studying without pay?

Hello all, my Labor Cert was filed in late 2004 under the RIR regime. Was later "re-filed" under PERM in Oct. 2005. I am an EB-2 candidate (Indian citizen).
The DOL denied the application for Labor Certification filed under PERM recommending that the requirements for the position offered include the phrase " any suitable combination of education, training and experience is acceptable" The denial offers both the option of filing a motion to reconsider and refiling the application with the amended requirements. The law firm hired by my employer has filed a "motion to reconsider". In addition they are in the process of re-filing the application with the amended requirements. My question is-how quickly (from your experience) does the DOL take to respond to the motion to reconsider (my lawyers referenced a memo sent out earlier this year from the DOL in which a 3-4 month timeframe was mentioned).

It means nothing. The second 485 was denied since you already have a green card so
Adjustment of Status is not required.
BTW - why did you file two 485's ?

Hi guys,
I got as well the unlucky audit like almost 80% of the people filing for a PERM.
My L1 visa is expiring on May 14th and the PERM audit reply was on Jan 28th and based on the current cases pending, I will hearing back from Atlanta sometimes between July-August.
I also applied for the H1-B and get approved but it is starting on Oct-1st,2008
1.- Can I stay "out-of-status" based on the INA 245 that "allow us to stay up to 180 days because change of status in process"?
2.- This changes of status process is valid only when you file the I-485 or for anyone already starting GC process like PERM in process?
3.- If I need to come back to my country and get the H1-B stamped, Do I loose the current PERM even if it get aproved or can I use the same PERM once aproved and apply for I-140/I-1485 concurrently (because EB-2 category) no matter I 'll have a different Visa H1-B instead of L1-B stated in the PERM?

My company got one previous LC approved whose requirements are BS in CS or Engg related. I have a civil engg degree, I would like to file I140 and get old PD. Will this substitution work? If anyone with "non CS" engg degree used a labor that asked degree in "CS or Engg rel" in item 14 on 750A please share your response.

No. You can't port PD from spouse.
You can port your own PD, if you have another EB3 approved.
You can port the country of chargeability, if she was born in another (ROW) country.
My priority date is in 10/2006 under EB3. My wife just start her GC process under EB2. Can my wife port my PD date to her GC application?

Please help me with this. i came to USA on L1B visa in 2005 with 1 year petition and got extension for 2 more years i.e till feb 2008 but went to india for good in June 2007.
Again we came back with new L1B petition in Oct 2007 and got 3 years visa i.e, till Oct 2010.
1) Now if company apply for extension on L1B how many years ext i'll get?
2) Now if Company B wants to file new H1B for me, how many years of visa i'll get.
i was never on H1 before this is my first time H1B.
Please help me with this as soon as possible.
