Good news for EB2-I people with 1999 and earlier PD's. They have been waiting far too long. Good luck for them. They have now done 10 years in the US, and will qualify for SS, anyway.

As PERM processing becomes faster in recent months, icert problems continue though. DOL has reported that the incorrect error message that pops up upon entering a date for the prevailing wage source is the result of recent system edit. The glitch will not affect useability, i.e., users can bypass the error message and submit LCAs for processing. In addition, a fix is in development and will likely be in place today or tomorrow. Common recent problem is receiving an inappropriate system warning when entering the Prevailing Wage source. We hope these problem will be fixed soon as the PERM process becoming rather annoying. We will keep our readers posted.

Say if one has two I-140 and wish to port the priority from the older one to the later one. And if the USCIS does not agree with your filing(maybe they will say the filing is not possible or not portable). What will they do? Will they deny the I-485 or will they just reject the application. If so will it cause an issue when the later priority date is reached and during the application of the following I-485.

Hi,
Some where in May I heard the news that end of this year USCIS is going to halt concurrent filing of I-140 and I485 and introduce an extra step called preApp of I485 which can be done only after an I40 approval. I would like to know if this is really going to happen?
I have an approved I140 and a PD of Apr 08. I am planning to change the company now. My doubts are
1) Suppose if USCIS changes rules and introduce an extra step for preapp of I485.
What will happen if I switch company after 180 days of preapp of 485. can I invoke Ac21 ?
2) will I be eligible for EAD/Parole after preapp of 485?
Any body having any knowledge about this please share.

I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?
Thanks in advance for your advice!

This is very confusing. I already sent my I-485 along with a new filing fee of $1010 in total $930 for the application and $80 biometric fee last August 3rd. USCIS already received my application my question is are they going to reject my I-485 b/c they just revised that we have to pay the old filing fee for July Bulletin? I used The current I-485 form version dated �7/30/07 Y�.
I'm so confused! Due to this, I'm just gonna send another application b/c the chances of them rejecting/returning it back to me is High. If they don't return it back this week then I won't be able to file my I-485 after August 17th. Is ok to send another application? Can I just attach an explanation? I would rather take this chance than not being able to file it again after Aug 17.

my first PWD was submitted on feb 8 and it came back apr 8. the wage was too high. so a new pwd was submitted on apr 16. it came back today with a proper wage.

As we are sure that the August 2009 visa bulletin EB2 India date movement is due to spill over from higher priority categories, is there any way to find exactly how much visa numbers got spilled over to EB2 India and China?
