This is commendable and also an interesting development because it means that the pro-immigration community is essentially saying that it is necessary to allow one group to receive an important immigration benefit out of lockstep with comprehensive immigration reform. Hello friends,
Would really appreciate if someone can share some information on this topic.
My Labor has been approved as software Engineer in current job, even though all responsibilities are that of Database Administrator.
I am planning to invoke AC21 and my new job responsibilities are an exact match with my current labor, but, the title is Database administrator.
Is there any risk involved in it ?
Any input is greatly appreciated...

Guys, I am efiling 765 for EAD renewal. last year, my lawyer filed 765 and sent a G-28 along with that. This time, I am efiling on my own, do I need to send the G-28 ?
also, please let me know if photos are required to sent after efiling 765.
my AP is expiring sometime in mid Oct and EAD is expring on 30 Sep. I am efiling EAD on 30th of May, can I do the same for AP though, it will still be more that 120 remaining for AP?

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?

Switched jobs in April 07. My attorney tells me that my Labor can be filed only in mid July at the earliest.
1. How long does it take for Labor to be approved? I am guessing end of September is when retrogression will kick in. Do I have enough time for that?
2. How long does it take to get the documents ready for to file I-140 and I-485 (counting eggs before it's hatched)? If I have Birth and Marriage certificates ready, is there anything else that I should watch out for?
BTW, don't think I am trying to take a short cut to independence. I did my time in backlog for 3 years, got fed up and quit.

If we are on H1 and able to file I-485(AOS) and continue to be on H1 until it expires. Then are we automatically on AOS after the expiry of H1? Or do we have to inform USCIS our intent to switch to AOS?
The reason I am asking this question is: I saw a case, although not similar, where the individual was on H1 and applied I-485 (inJuly 2007), he continued on H1 until it expired and decided to stay on h1 and so his employer applied for extension of H1 in 2009. At that time he received an RFE, the employer did not respond to the RFE. So, eventually the H1 Extension was denied.
After that USCIS denied his I-485 also. Reason give was: "Since the H1B EOS (Extension of Status) request was denied, it did not grant, or have the effect of granting, a lawful status during its pendency."
Please have your thoughts on this. Cause I am sure many of us have started using EAD, but did we transition the right way from H1 to EAD?

Hi Gurus,
If you look at my signature, My 485 has been transferred to TSC from NSC and AP is still stuck at NSC. I have some emergent situation back home , I have faxed the doctor certificate and called USCIS using POJ method and the guy says it might take another month. wat the *****....tried infopass..my local office doesnt have no more appointments.
My questions:
1. Can I take Infopass appointment anywhere else which is not my local office?
2. Can I apply a new 131 application at TSC as my 485 is there now?
Someone pls advise.

My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

As Birth Certificate is part of Initial evidence, 2 secondary evidence affidavits for incomplete/incorrect entries is always good for peace of mind. Search for numerous threads on Birth Certificates last month for affidavit format, who can provide etc.
