I am aware of the recent revisions to the State Department immigration bulletin, and I am concerned about how these change s will impact the many individuals who have based their immigration plans on information from past bulletins, which stated that certain employment- based categories were current. Please be assured that I will continue to monitor the Department of State's response to this issue, and I will be in touch with relevant officials to express my concerns about this unfortunate situation . In the meantime, should you need any assistance with your visa application , please do not hesitate to contact my state office at (800) 443- 8658.

Coming in through H1 does'nt show your intention of becoming a permanent resident of this country. It only happens when the LC is applied. Although the entry date is an ingenious way, it will only create more issues. Now some one who comes in F1 can also ask for the same benefit when they move to H1, to take their entry date in F1 as their priority date. I believe the culprits are the labor substitution and the labor certification sales. Those are unfair. Stop labor substitutions, and if they need one, then use the 140 RD as the PD. That should solve most of the problems and people from using labor sub to jump the line.

I am guessing that your EAD was driven by the address which you provided while applying for it. CIS may not confirm what's on file, when there is already an address mentioned in application itself.
This could very well be true. My first biometric appointment notice was mailed to me when I was changing residence, and it probably went to the old address, I remember not receiving it and my old attorney's office sending me their copy of it. I had done the AR-15 update right around the same time, but I guess it didn't go through. Anyway, since I spoke directly with someone in Nebraska this time around, I am hoping they now have the right address on file.

Good they have seem to have read recently published IV analysis and recommendations and provided a much more detailed bulletin this month for the community.
agreed. kudos to IV core to push for more detailed explanations without which proposals for fixing this backlog also becomes difficult.

my labor was MS + 2 years. Attorney did not file my I140 under EB2 because I have 23 months full time experience and 2 years GA experience.

66K plus 60K still only makes 126K, do they still have another 20K or so? How does the math tally here?
I think this all boils down to them wanting to clear the 485 backlog without accepting any more 485s all while not wasting any visa numbers for this year.
In an effort to juggle all these issues, they screwed it all up.
Bottom line is they want to streamline the system such that they don't have "unapprovable" 485s in the system. They have caught on to the way the lawyers and us legal immigrants were filing 485s to get our foot in the door then sitting tight for eons. They simply don't want that. They either want you here on a visa or on a green card straightforwardly. Thats what I am getting from all this.

If they think that we should be on GCs or VISA only, then they would be already working on streamlining the sytem instead of wasting so many VISAS every year as per Ombudsman's report.

OK here is a question.
Person working for past 4 years in the US.
Applied LC this February (2/26/07)
wants to go to canada and then reenter may be next year.
According to the new point based GC system--
1) Will the person get points for the 4 years of work in the US? (those 4 years were continuous, however, the person applies for GC after the canadian break of lets say 1 year)

hi,
In case you have a visa stamped on your passport (even if its expired ) give it to them, also talk to your loan agent at the bank and ask him to pass the details to the underwriter,loan agents dont understand the immigration intricacies but the underwriters do- it may take a few more days but eventually they will approve it.
